Terms of Use

1. Acceptance

These Terms of Use (the “Terms”) govern your use of the OpenCal AI mobile application (the “App”), published by Alovate, a Delaware, USA company (“Alovate,” “we,” “us”). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years oldto use the App. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian’s permission to use the App and agree to these Terms on your behalf.

3. License

Subject to these Terms, Alovate grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use. You do not acquire any ownership interest in the App.

4. Acceptable use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the App, except as permitted by law.
• Interfere with the App’s operation or attempt to gain unauthorized access to our systems, other users’ data, or third-party services we use.
• Submit content that infringes the rights of others or is unlawful.
• Use the App as a substitute for professional medical, dietary, or nutritional advice.

5. In-app purchases & auto-renewing subscriptions

The App offers optional in-app purchases and auto-renewing subscriptions. The following terms are required by the App Store and apply to subscriptions purchased through Apple:

• Length and price of each subscription are shown in the App before you purchase.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-renewal: the subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal charge: your account will be charged for renewal within 24 hours prior to the end of the current period.
• Managing & cancelling: you can manage and cancel your subscription by going to Settings → Apple ID → Subscriptions on your device.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Subscriptions purchased through Google Play are governed by Google’s corresponding terms and can be managed from the Google Play Store app under Subscriptions.

6. Disclaimer of warranties

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Calorie and nutrition estimates are AI-generated approximations and may be inaccurate. The App is not a medical device and is not a substitute for professional medical, dietary, or nutritional advice.

7. Limitation of liability

To the maximum extent permitted by law, Alovate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the App. Our aggregate liability for any claim arising out of or relating to these Terms or the App is limited to the amount you paid Alovate for the App in the twelve months preceding the claim, or USD $50, whichever is greater.

8. Termination

You may stop using the App at any time. We may suspend or terminate your access if you breach these Terms. You can delete your account from Settings → Delete Account inside the App.

9. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of these Terms shall be the state or federal courts located in Delaware, USA, and you consent to personal jurisdiction there.

10. Changes

We may update these Terms from time to time. Material changes will be communicated in the App or on this page. Continued use of the App after changes take effect constitutes acceptance.
